The Lexington Board of Education met in regular session in the Robert H. Whitney Board of Education Meeting Room at 7:00 p.m. on  Wednesday, June 27, 2018.

Mr. Robert Whitney, President, called the meeting to order. Roll was called by the Treasurer.

VISITORS / COMMUNICATIONS / RECOGNITIONS

            Mr. Whitney welcomed visitors to the meeting and asked if any visitors would like to be recognized.

Karen Gilbert, President and CEO of the Mansfield YMCA, gave the Board a presentation regarding the Y Kids Club program.  This fall the "Y" will provide locations within each of the Lexington elementary schools to provide locations within each of the Lexington elementary schools to provide before and after school child care services. Packets were sent home to parents of elementary students within the District. In addition, the program is open to faculty/staff of Lexington Schools who will receive a 25% discount for any students of their own who are enrolled. Kids enrolled in the program will also a "Y" membership, and the families of those students can also obtain a discounted "Y" membership. The program will also provide services during snow days and two-hour delasy allowing flexibility for families of students enrolled in the program. A Summer Enrichment Program will also be offered. Children only need to come on an as-needed basis, and the costs are $35.00 per week for before or after school and $60.00 for both before and after school. Families will also be able to arrange with the bus garage for any students that need to be transported to another school.

     FINANCIAL ITEMS 

32-18   Motion by Mr. Stoner, seconded by Mr.Roberts to approve the following financial items:

1. The minutes from the June regular meeting were approved.

2. The monthly financial report for June 2018 was presented.

3. Approved an invoice from Nationwide Children's in the amount of $50,680 for student occupational and speech therapy services.

4. Approved Resolution Determining to Proceed with a Bond Issue and Permanent Improvement Levy for election on November 6, 2018.

RESOLUTION DETERMINING TO PROCEED WITH AN ISSUE OF BONDS AND LEVY OF AN ADDITIONAL TAX IN EXCESS OF THE TEN-MILL LIMITATION AND CERTIFYING THE SAME TO THE BOARD OF ELECTIONS

(Ohio Revised Code Section 5705.218)

WHEREAS, the Board of the School District, at its meeting on June 27, 2018, passed a resolution (the "Resolution of Necessity") that determined it is necessary to issue bonds in the amount $55,950,000 (the "Bonds") for the purpose of constructing school facilities and renovating, improving and constructing additions to school facilities, inlcuding safety and security improvements, under the Classroom Facilities Assistance Program of the Ohio Facilities Construction Commission; furnishing and equipping the same; improving the sites thereof; and acquiring land and interests in land as necessary in connection therewith; and that it is necessary that a diret tax be annually levied on all the taxable property in the School District outside of the ten-mill limitation to meet the debt charges on the Bonds and any securities issued in anticipation thereof; and

WHEREAS, the County Auditor of Richland County, Ohio (the "County Auditor") has certified to the Board that an estimated annual levy of 8.6 mills for each dollar of tax valuation, which is $0.86 for each one hundred dollars of tax valuation, will be required to produce the average annual property tax levy necessary to pay the principal and interest on Bonds over 37 years (the maximum maturity of the Bonds); and

WHEREAS,  the Board also determined in the Resolution of Necessity that it is necessary, in order to provide funds for the acquisition, construction, enlargement, renovation, and financing of permanent improvements for the School District, to levy an additional tax (the "Levy") in excess of the ten-mill limitation at the rate of 0.50 mills for each one dollar of tax valuation, which amounts to $0.05 for each $100 of tax valuation, for a continuing period of time; and

WHEREAS, the County Auditor has certified, to the Board, that the dollar amount of revenue that would be generated by the Levy during the first year of collection is $3,077,100, based on current tax valuation of the School District of $357,802,400.

NOW, THEREFORE, BE IT RESOLVED by the Board of Education of the Lexington Local School District, Richland and Morrow Counties, Ohio, two-thirds of all the members thereof concurring that:

Section 1.  It is necessary to proceed with the issuance of the Bonds and approval of the Levy in the amounts and for the purposes described in the preambles to this Resolution, and to levy, outside of the ten-mill limitation provided by law, an annual tax on all the taxable property in the entire territory of the School District to pay debt charges on the Bonds and any securities issued in anticipation.

Section 2.  The Bonds shall be dated approximately December 1, 2018; shall bear interest at the estimated rate of 5.25% per annum; and shall be paid over a period not to exceed 37 years as calculated under Ohio Revised Code Chapter 133.

Section 3.  The question of issuing the Bonds and approving the Levy shall be submitted to the electors of the School District at the election to be held at the usual voting places within the School District on November 6, 2018.  All of the territory of the School District is located in Richland and Morrow Counties, Ohio.

Section 4.  The Form of the ballot to be used at said election shall be substantially as follows:

AFFIRMATIVE VOTE IS NECESSARY FOR PASSAGE

Shall the Lexington Local School District be authorized to do the following:

(1) Issue bonds for the purpose of constructing school facilities and renovating, improving and constructing additions to school facilities, including safery and security improvements, under theClassroom Facilities Assistance Program of the Ohio Facilities Construction Commission; furnishing and equipping the same; improving the sites thereof; and acquiring land and interests in land as necessary in connection therewith; in the principal amount of $55,950,00 to be repaid annually over a maximum period of 37 years, and levy a property tax outside the ten-mill limitation, estimated by the county auditor to average over the bond repayment period 8.6 mills for each one dollar of tax valuation, which amounts to $0.86 for each $100 of tax valuation, to pay the annual debt charges on the bonds, to pay debt charges of any notes issued in anticipation of those bonds?

(2) Levy an additional property tax to provide funds for the acquisition, construction, enlargement, renovation, and financing or permanent improvements at a reate not exceeding 0.50 mills for each one dollar of tax valuation, which amounts to $0.05 for each $100 of tax valuation, for a continuing period of time?

Section 5.  The Treasurer of the Board is hereby directed to certify a copy of this Resolution, along with copies of the Resolution of Necessity and the certificates of the County Auditor, to the Board of Elections of Richland County, Ohio (the "Board of Elections") on or before August 8, 2018. The Treasurer of the Board is hereby directed and shall simultaneously certify to the Board of Electiosn that the Levy will be for a continuing period of time, and that the Levy will include a levy on the current year's tax list (commencing in 2018, first due in calendar year 2019) if approved by a majority of the electors voting them.

Section 6.  It is hereby found and determined that all formal actions of this Board concerning and relating to the adoption of this Resolution were adopted in an open meeting of this Board, and that all deliberations of this Board and any of its committees that resulted in such formal action were in meetings open to the public in compliance with all legal requirements, including Ohio Revised Code Section 121.22.

School Resource Officer : Approved the employment of Officer Mike Davis as the Lexington School Resource Officer (SRO) for the 2018-2019 school year.

Memorandum of Understanding: Approved the School Resource Officer Memorandum of Understanding Agreement with the Village of Lexington. The length of agreement will be through July 31, 2021, and shall automatically renew for successive periods of one year (August 1 through July 31) unless at least three months written notice is given by either party.

Certificate Section 5705.412, Ohio Revised Code 

It is hereby certified that the Lexington Local School District Board of Education, Richland County, Ohio, has sufficient funds to meet the contract agreement, obligation, payment or expenditure for the above, and has in effect for the remainder of the fiscal year and succeeding fiscal year the authorization to levy taxes which, when combined with the estimated revenue from all other sources available to the district at the time of certification, are sufficient to provide operating revenues necessary to enable the district to operate an adequate educational program on all days set forth in its adopted school calendar for the current fiscal year and for a number of days in the succeeding fiscal year equal to the number of day’s instruction was or is scheduled for the current fiscal year.
